III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection of the New Horizon Mine for the month of September, 2002. Thee purpose <br />of this inspection is to conduct a Phase 1 bond release and normal operations and environmental <br />compliance. The weather was cloudy and rainy. <br />ROADS: Haul roads and the BB road detour was inspected and no problems were noted <br />HYDROLOGIC BALANCE: Mine 2: Pond 7 and 8 had water in them but were not discharging. All <br />ditches and culverts were clear and capable of functioning as designed. Pond 9 was dry. <br />BACKFILL 8 GRADING: B & G was in progress as is normal. No problems were noted. The land <br />continues to be reclaimed to the approved post mining topography. The site was inspected with Marvin <br />Walisky representing San Miguel Power Association, and Ward Burbridge for his land. Mr. Walinsky <br />stated that San Miguel Power wishes for Pond 7 to remain and replied that they would send a letter to the <br />Division stating their request. He was very satisfied with the condition of the land. <br />As noted in previous inspections, There is a low spot in the Burbridge property that will be repaired later <br />this fall. Several potholes from the side-roll irrigation system draining were noted and they will be repaired <br />this fall as well. Mr. Burbridge was very pleased with the alfalfa production that land is producing and <br />other than the one low spot and the few potholes, was pleased with the reclamation. <br />EXPLOSIVES: Records were inspected and found to be in compliance. All blasting procedures are being <br />followed and seismograph's readings are available for each blast. During a previous inspection, it was <br />noted that not all residents within a half mile of the blasting area were sent a notice of the blasting <br />schedule, so NOV CV 2002-020 was issued. The mine, however, noted this discrepancy and immediately <br />rectified the situation and therefore the NOV was terminated on September 30. <br />TOPSOIL: Topsoiling continues to be laid down in the prescribed depths. <br />GENERAL MINE COMPLIANCE: The mine continues to exert an outstanding effort to comply with all <br />rules and regulations of the Colorado DMG. <br />RECLAMATION SUCCESS: The site is exceptional in its reclamation efforts <br />
