The site <br />used to be a small 9.9 acres sand and Gravel operation located in Elbert County 6.5 miles north of Elizabeth on County Road <br />21. Present during the inspection was Mr. Penwell of Elbert County. The site was reclaimed in 1993 and a request for <br />release was filed with the Division in August 1995. Release was denied due to erosion gullies noted on the North slopes. <br />The inspection also noted that there were three stock ponds in the pit floor, which required a letter from the landowner <br />accepting the responsibiliri for these ponds, prior to release. When the site was inspected on 3-17-98, it was noted that the <br />slopes were repaired and reseeded. However, since the post mining land use did not mention stock ponds, the operator was <br />required to submit a technical revision to change the post mining and use as stock ponds. A corrective action date of <br />7/31/98 was Riven to the operator. The TR was never submitted, however, on December 9, 1999, the operator included with <br />the annual report a release request for the site Unfortunately because the release request was included with the annual <br />report it was not discovered until the site inspection of 406-00. The site has been fully reclaimed. The stockponds are in <br />place Small water was being retained from the recent snowmelt. As is the case with any low-lying area in the district, water <br />from an event be it snow or rain is going to be retained. If the operator submits a release request in accordance with Rule <br />4.16 of the Construction Materials Rules and Regulations, and also provides a letter from the landowner stating that he is <br />satisfied with the reclamation of the site, the Division will release the site with out further inspection.
