III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division <br />of Minerals and Geology. This former underground site is entirely reclaimed. Mr. <br />A.J. Iuppa, the landowner at the site, opened the gate to allow access to the <br />area. Ground conditions were wet and muddy due to recent rain. The weather was <br />cool and overcast. <br />Availability of Records <br />The public copy of the mine records is now maintained for review at the Office of <br />the Clerk and Recorder of Las Animas County at the Las Animas County courthouse in <br />Trinidad. Records were found neatly filed in the vault. Results of the <br />inspection are detailed on page 2a of this report. <br />Hydrologic Balance <br />Ditches and culverts around the site all appeared in good working order. The lone <br />sediment pond held a small amount of water at an elevation immediately below the <br />discharge point. The pond riser trash rack looked to be in good condition as did <br />the emergency spillway. <br />Processing Waste <br />The south-facing slope of the refuse highwall was traversed on foot. No sign of <br />slumps. slides. or damage was noted. Contour furrows appeared in good condition <br />and ready for spring runoff. Seeps or springs were not noted from the refuse <br />highwall area. The 100-year ditch above the refuse highwall should be cleaned <br />again along the lower section due to sedimentation from undisturbed areas above <br />the ditch. The armored channel lining was found in excellent condition. <br />Revegetation <br />Grasses are beginning to show signs of serious growth for this season. Cicer <br />milkvetch is also sprouting over most of the reclaimed area. South facing slopes <br />are generally ahead of other areas in terms of new growth. Interseeded areas <br />appear to have more grass plants than previous years. Long-stem grass mulch <br />remains visible over the interseeded areas. Cover on the topsoil footprint area <br />is excellent. <br />Overall, the site appeared in good condition for early spring. Recent moisture <br />from snow melt and rain has been beneficial. <br />3 <br />
