LII. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of obsen~ations mach during the inspection. <br />Comments also describe any enforcement actions taken during the inspection and the faces ore.-idence supporting We <br />enforcement action. <br />This was a partial inspection of the Bear #3 Mine. There were few activities occurring at the site. <br />Considerable reclamation preparation work has been conducted within the past few months. The <br />conveyor from the portal to the stacking has been removed. The staking tube has been taken down and <br />is lying on the ground awaiting dismantling. Other materials and supplies are being removed. Bear <br />Coal Company has two employees working full-time on the site clean-up and reclamation preparation <br />operations and is in preliminary discussions with a reclamation contractor. <br />Availabili(y of Records <br />The three requested additions to the records file are still at the Bowie # 1 Mine office. Those records <br />will be brought down and included in the files shortly. <br />Signs and Markers <br />Permit boundary markers have been replaced along the northwest perimeter, adjacent to the pond. In <br />addition, a new sign identifying where the public can review the mining and reclamation permits at the <br />DMG offices has been added to the signage located at the entrance to the mine site. <br />Hydrologic Balance <br />The sediment pond continues to receive considerable runoff from the site. Water is dischazging from <br />the pond, as it has been since 3-17-97. The discharge appears clear and is flowing at a rate of <br />approximately 1. g.p.m. Considerable slide movement azound and adjacent to the portals has completely <br />disrupted the water handling system which had been installed. Currently runoff is being handled and <br />directed through makeshift culverts and ditches as best as can be expected in light of the significant <br />movement which occurred in the past. All runoff is successfully being directed to the pond, so sediment <br />control has ultimately not been compromised. <br />The small sump immediately above and adjacent to the bridge over the river is receiving constant flow <br />of a few g.p.m. from the adjacent area. The current straw bale filter is in good shape but could use <br />some preventative maintenance. <br />Slides and Damaee <br />Basil Bear indicated that no additional slide movement had occurred during the past month. A few <br />small cracks were noted neaz the edge ofthe portal access road, which may indicate some further <br />movement is in store. <br />
