ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn-t 988_ne~ <br />INSPECTION DATE: 'i/~/na INSPECTORDS INITIALS: _)3~ <br />OBSERVATIONS <br />The Division conducted a joint inspection of the site with representatives <br />from the Division's Coal Program. The Coal program received a compliant <br />from one of their operators stating that Fremont Paving mix had mined a <br />portion of a reclaimed coal load out area, which is adjacent to the sand <br />and gravel operation. The purpose of the joint inspection was to determine <br />the facts and the extent of the infraction committed by the aggregate <br />operation permit # M-1988-093. Present during the joint inspection were, <br />Mr. Jim Stark, from the Division's Coal Program, Mr. George Patterson, from <br />Energy Fuels Coal Co. and Ms. Denise Gonzales from Redi Mix. According to <br />Mr. Patterson, Redi mix had mined out approximately % of an acre south of <br />the railroad trucks, which was a reclaimed load out site for Energy Fuels <br />Coal Mining permit. According to Ms. Denise Gonzales, of Redi Mix, no <br />actual mining took place in the area; rather material from the aggregate <br />operation, mostly over burden was placed from their mining operation and <br />pushed back, to their main pit area. Approximately % of an acre in the area <br />reported by the coal program appeared to have been graded. Overburden <br />appeared to have been pushed to with in 50 feet of the railroad trucks. <br />However, since both the Energy Fuels permit boundary markers and the Redi <br />mix's permit boundary markers appeared to have been removed, it was <br />difficult to determine, if this area was permitted by both operations. <br />Preliminary indication of all maps submitted with the aggregate industries <br />original application indicates, their permit area, to be with in 100 feet <br />of the railroad trucks. If such is the case, it appears to be an <br />overlapping permit, if indeed, the Energy Fuels Load out included the areas <br />covered under permit #M-1988-093.There also appears to be some dispute as <br />to who actually owns the area in question. Because of permit boundary <br />uncertainties, the division requested the following from the Aggregate <br />operator. <br />1) Conduct a title search to determine the actual landowner. <br />2) Provide a survey of the permit area, working closely with Energy <br />Fuels, to determine the actual permit area for permit # M-1988-093 no <br />later than 3-31-04. <br />3) From the Coal program, a copy of the reclaimed top map for the area <br />in question. <br />Once all the information is provided, the Division will determine the next <br />course of action. Because of permit boundary uncertainties, a possible <br />problem in the mine plan will not be sited at this time. <br />18.
