III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Gillis of the Colorado Division of Minerals and Geology. <br />With the operator's consent, this report was issued from the Durango office. Skies were mostly sunny and <br />the site had approximately 6 in. of snow on the ground at the time of the inspection. <br />Hydrologic Balance <br />Both sediment ponds were inspected and found to be functioning properly. Collection ditches were clear, <br />and the small diversion ditch located at the base of the cut slope on the north side ofthe gob pile appears to <br />have been cleaned out recently. <br />Processing Waste <br />The waste pile showed no evidence of structural instability. With the presence of snow cover, the grading <br />and shaping of the pile surface could be observed more easily. It appears that the pile is being adequately <br />maintained at the necessary positive gradient to route surface water off the pile surface and into to the <br />collection ditch running along the south edge. <br />
