If the exposed groundwater associated with this site was exposed as
a result of the mining of sand and gravel, the applicant, pursuant to C.R.S. 37-90-137 (11),
must obtain a gravel pit well permit. From our files it does not appear that the applicant
has obtained such a gravel pit well permit. In addition, if the groundwater was exposed
after December 31, 1980, either a water court approved augmentation plan or a State
Engineer approved substitute supply plan, to replace the depletions to the stream system
resulting from open mining of sand and gravel, must also be obtained. Aoain, from our
files, there is no evidence that eith_er_the groundwater associated with the_sit_e_ was
exposed prior to December 31, 1980 or that the applicant has approval of a plan to replace
the depletions to the stream svstem resultino from mining operations after December 31,
1980
If you have any questions, please contact this office at (303) 866-3581 .
Sincerely,
Megan Sullivan
Water Resource Engineer
cc: Dave Nettles, Assistant Division Engineer
file
