If the exposed groundwater associated with this site was exposed as <br />a result of the mining of sand and gravel, the applicant, pursuant to C.R.S. 37-90-137 (11), <br />must obtain a gravel pit well permit. From our files it does not appear that the applicant <br />has obtained such a gravel pit well permit. In addition, if the groundwater was exposed <br />after December 31, 1980, either a water court approved augmentation plan or a State <br />Engineer approved substitute supply plan, to replace the depletions to the stream system <br />resulting from open mining of sand and gravel, must also be obtained.
