III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on August 10, 2006 by Mike Boulay <br />and Sandra Brown of the DRMS. Dennis Bugay of Seneca Coal Company (SCC) was present <br />during the entire inspection. Weather conditions were sunny and warm. Ground conditions at <br />the mine site were dry. <br />Hydrolo¢ic Balance <br />Sediment Pond O11A in the North Pit was inspected. This pond was retaining a significant <br />amount of water but was not discharging. The pond inlet, discharge structure and embankment <br />were all stable. Improvements to Post Mine Channel YPM-10 were completed approximately a <br />yeaz ago. The lower portion of the channel was realigned and straightened out to improve the <br />stability of the channel above its confluence with YPM-11. YPM-10 appeazed stable and the <br />improvements made to the channel aze holding up well. Two gullies were noted on the south <br />side of YPM-10. The gullies aze significant and run adjacent to the channel. These should be <br />repaired by backfilling and reseeding. Another gully was noted at the base of Post-Mine Channel <br />YPM-9 above Pond O11A. This gully should be repaired as well. Sediment Ponds 010 and 012 <br />were viewed. These ponds were retaining water and appeazed stable with no problems noted. <br />Topsoil, and Reve etg ation <br />Topsoil redistribution appears current in the Yoast South azea. Seven scrapers were running at <br />the time of the inspection; working to redistribute topsoil in the Wolf Creek Pit. Seeding of <br />recently topsoiled azeas should be completed this fall to maintain compliance with permit <br />conditions. <br />Slides and Damaee <br />As mentioned in the last inspection report (dated July 31, 2006) there is a new visible crack <br />across the slide area above Pond 012. However, the regraded area in the vicinity of the slide does <br />not appear to have moved any since the last inspection. SCC is continuing to work towazds <br />stabilizing the slide azea. <br />
