III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />19 June 2006 <br />Pg 1/6 ~d_ <br />Below are comments on the inspection. The comments include discussion of observations <br />made during fhe inspecfion. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br />CDMG. The inspection was conducted on 19, 20 and 21 June 2006. Records were <br />checked on 19 June 2006 with Kurtis Blunt, Tony Tennyson accompanied me on 20 <br />June 2006 and a summer intern accompanied me on 21 June 2006. Tay Tonozzi was <br />present on the morning of 20 June 2006 to discuss ongoing and future permitting <br />actions. The mine was actively mining coal and hauling coal to the loadout at the <br />time of the inspection. The weather was warm and sunny and the ground was dry. <br />On the morning of 20 June 2006 Tay Tonozzi and I discussed current and future <br />permitting actions. Since the last inspection on 2 May 2006, the Division proposed a <br />decision to approve Technical Revision 62. TR-62 was a change to the replacement <br />depth of topsoil on the mine's remaining reclamation. The mine changed from a <br />replacement depth of 18" to a replacement depth of 8". The Division has sent a <br />second adequacy review letter to CCC regarding a change to the mine's post- <br />mining topography. CCC has received the letter and will respond to the Division's <br />questions. The Division has also sent a preliminary adequacy review letter to CCC <br />regarding Technical Revision 64, which is a request to terminate quarterly inspections <br />at the Streeter and Section 16 excess spoil fills. CCC has received this letter and <br />indicated that they would perform the final certifications of the piles as requested. <br />Finally, the Division has sent a preliminary adequacy review letter to CCC regarding <br />Technical Revision 65, which is a request to extend mining of the Section 16 Pit to the <br />south, increasing the disturbed boundary by 44 acres and the affected boundary by <br />58 acres. The Division consulted with Carl Johnston of the OSM and he indicated that <br />this revision would not require a federal mine plan modification. <br />Tay and I also discussed the pending South Taylor expansion. CCC is working with <br />Walsh Environmental to finalize the permit revision. Tay was working on writing the <br />operations and reclamation plans while I was on site. The permit revision is <br />scheduled to be complete and sent to the Division by 3 July 2006. <br />Availability of Records: -The records were checked on the afternoon of 19 June 2006 <br />with Kurtis Blunt of CCC. All of the necessary were available at the mine's office. See <br />the DMG Availability of Records checklist attached at the end of this inspection <br />report for more details. <br />Signs and Markers: -All of the necessary signs (including mine ID signs, disturbed <br />boundary signs, stream buffer signs and blasting signs) were in place as required and <br />contained all of the necessary information. <br />
