III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action, <br />Jerry Nettleton, Brian Watterson, and Sandra White represented the operator during all or part of the <br />field portion of the inspection. Sandra White represented the operator during the records check. <br />AVAILABILITY OF RECORDS <br />All required records were available (see attached checklist). County Special Use Pennits appeared to <br />be numbered. The discussion about County special use permits on page 2.03-37 of the Permit <br />Application Package (PAP) needs to be updated to reflect current practices by the County. <br />SIGNS AND MARKERS <br />It appeazed that the permittee was not in complete compliance with the requirements of Rule 4.02.2 (1) <br />regarding mine and permit identification signs at the points were permit boundaries crossed public <br />roads. The Division discussed the requirement for these signs with the permittee, who was in the <br />process of changing mine ownership at the time of the inspection and who was unsure of new sign <br />formats and purchase approval procedures under the new owners. The Division is in receipt of a <br />Technical Revision (TR 43) to change ownership and control information in the mine permit. Upon <br />approval of this TR, the permittee must install these signs as required. Signs required by Rule 5.02.3(1) <br />were observed at entrances to the following surface coal mining and reclamation operations: Fish <br />Creek Tipple, Eastern Mining District Vent Shaft, Northwest Mains Vent Shaft, and the Fish Creek <br />Borehole. Topsoil markers and stream buffer mazkers were properly displayed at numerous locations <br />inspected.
