III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the CDMG. This coal <br />operation is currently under a temporary shutdown due to market conditions. <br />Significant reclamation work, mainly backfilling and grading, has been completed <br />in the last six months. The weather was clear in the morning with rain showers <br />and thunderstorms on the site later in the afternoon. Ground conditions were <br />generally dry prior to the rainfall. <br />Signs and Markers <br />The mine identification sign was present immediately south of the new bridge <br />across the Purgatoire River that provides access to the site. The mine phone <br />number has been disconnected and the mine ID sign requires modification to display <br />a working phone number in the area. The operator should make this change prior to <br />the next State complete inspection. <br />Roads <br />Culverts along the Jeff Canyon haul road were clear and functioning as designed. A <br />culvert appears to be necessary on the Lorencito Canyon haul road south of the <br />it's intersection with the Jeff Canyon haul road. Diversion of flow to the south <br />to Jeff Canyon in the western road ditch has not been successful due to the <br />existing grade of the road. Instead, water flows to the north in this ditch and <br />flows across the road surface of the Lorencito Canyon haul road at the <br />intersection. <br />The permanent road crossing the reclaimed area has been roughed-in. This road <br />will require culverts once the final post-mining topography is resolved during the <br />Permit Renewal process. The light-use road to pond 5 has also been repositioned <br />were it enters the disturbed area and this should also be modified on the <br />appropriate map during the Permit Renewal process. <br />The light-use road to pond 8 requires grading to restore drainage and prevent <br />flows from eroding the road cut slope above pond 8 and near the gas line crossing. <br />Hydrologic Balance <br />Pond 9 held water about two feet below the lowest hole on the principle spillway <br />riser. Pond 10 at the loadout held a small pool of water. Other ponds at the <br />site were in effect dry. Following the afternoon storm event pond 9 was observed <br />3 <br />
