Zigan has installed a 9-12" PVC pipe to the South Plate, in order to <br />extract water for the operation. <br />2. The pipe and service road are not permitted activities and lie outside <br />the permit boundary. <br />3. It appears from observation and testimony from DOW that Zigan used <br />equipment to create a sump in the river to extract the water (also <br />unpermitted activity and in violation of state and federal water law). <br />4. Zigan is also using the highway culverts for placement of the pipe. <br />RECOMMENDATIONS: <br />1. Bring Zigan before the Board for disturbance outside permit area and <br />unpermitted activities in the river. <br />2. Have Zigan amend permit to include these disturbances and acquire proper <br />state and federal water permits and highway easements. <br />/ep <br />Doc. No. 2106 <br />
