i. <br />Z <br />Ill. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Mark Milner represented the operator. There was no activity at the loadout during the <br />inspection. <br />Hvdroloey <br />Pond 1 and pond 2 were dry. The gate valve on pond 1 was closed. Pond embankments were stable and <br />well vegetated. The spillways were operational. <br />All of the ditches had sufficient capacity. All of the culverts were clear. <br />The silt fence and straw bales along the railroad tracks were in place and functional. <br />Facilities <br />The berm at the outer edge of the facilities bench was in place. The coal stockpile was away from the <br />outer edge of the bench. <br />The berm around the fuel facilities was in place. There were no leaks. <br />There was no problem with fugitive dust although there were no activities during the inspection. <br />There were no problems with any of the facilities. <br />Signs and Markers <br />Mine ID signs were up at the required locations and contained the correct information. <br />Permit boundary mazker signs were up around the mine site. <br />Topsoil Stockpiles <br />The east topsoil stockpiles were moderately vegetated. The west topsoil pile had good vegetation. The <br />collection and diversion ditches were functional. No gullying was observed. Topsoil signs were up. <br />
