III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented <br />the operator during the field inspection and the records check. The weather was dry and sunny. There <br />was no activity on site. <br />Hydrology <br />There was no water in Pond 4. The spillways were operational. The entire pond is well vegetated. The <br />culvert leading under the road to the pond was clear. There was some water in Pond 5, but below the <br />discharge inlet elevation. The spillways for Pond 5 were functional. Pond embankments were stable. <br />The main collection ditch leading into Pond 5 was well vegetated and had sufficient capacity. The <br />diversion ditch above the reclaimed coal stockpile azea across the road also was well vegetated. <br />Roads <br />The road leading up to Pond 5 was in very good condition, with only one muddy spot. The Hubbard <br />Canyon road was in good condition, although deep but dry wheel ruts were in one location. <br />Suns and Mazkers <br />The mine ID sign was up on the entrance gate but needs the new address of the operator <br />Reclamation <br />There was positive drainage off of the terraces of the reclaimed slopes. The reclaimed slopes appeared <br />to be stable. The vegetative cover was generally good and there were no signs of erosional instability <br />or slumping. No stability problems were evident with the backfilled highwall. There was a constant <br />drip of water coming out of the north underdrain pipe. However, the other underdrain pipes and black <br />pipe were dry. The inlet to the black pipe was clear. <br />Records <br />The mine records are located in the Delta County Courthouse.
