Erica Crosby Page 4 of 4 <br />September 21, 2004 <br />Water treatment, in conjunction with declining water levels in C-pit due to the improved <br />pumping system, are anticipated to lower the concentrations of the parameters of concern in a <br />timely manner. <br />Compliance <br />Cemex believes it is in substantial compliance with the 1999 Technical Revision to Permit No. <br />M-77-208 that addressed CKD disposal in C-pit. A-pit water is the approved monitoring and <br />compliance point. Monitoring of A-pit water indicates compliance with applicable water quality <br />standards as applied through the Technical Revision. C-pit water currently has exceedances of <br />certain water quality standards but it is not a compliance point. <br />We hope this letter satisfactorily addresses your concerns.
