III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />On November 29, 1994 a complete inspection was conducted at the Apex Mine <br />No.2. At the time of the inspection the weather was partly cloudy and very cold <br />with a stiff breeze blowing. There was about a foot of snow on the ground; about <br />6 inches appeared to have fallen since yesterday. The county road was covered <br />but was plowed this morning. This mine is undergoing permanent reclamation. <br />The snow cover prevented inspecting the newly installed channel across the <br />backfilled office area. The general configuration of the channel could be seen but <br />the honeycomb geotextile and fill was covered. There were some fresh footprints <br />walking up this drainage. <br />The fence surrounding the facilities area was in good repair and the gate was <br />closed. The pond was snow covered and didn't appear to have water or ice in the <br />bottom. <br />The road to the portal still requires additional reclamation. There could be <br />additional work to help blend this road into the undisturbed area. Even though <br />there are no available spoils to backfill this road it may be possible to roughen the <br />road or when the berm around the facilities is removed this material could be <br />placed on the road. <br />Availability of Records- The following records were located at the Routt County <br />Courthouse. <br />Item Comments <br />DMG Permit May 26, 1993 to May 26, 1998 <br />Permit Application w/ Revisions <br />Findings Document May 5, 1993 <br />Insurance Certificate 9/1/94 to 9/1/95, Incorcect liability waiver, need <br />mine name, company, permit number.
