III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of DMG. Henry Barbe represented the <br />operator. The ground was dry. With the operator's consent, this report was issued from the Denver <br />office of CDMG. <br />The longwall was active in panel 19. Development work was active in 20 headgate. <br />Availability of Records <br />All required records were on file in the mine office (see attached list). <br />Sins and Markers <br />Mine i.d. signs were properly displayed at the two entrances on Highway 133 and at the corrals <br />staging/laydown area. Topsoil markers were properly displayed on the numerous topsoil stockpiles <br />seen during the inspection. The disturbed area boundary was properly marked by a sign uphill from the <br />Materials Storage Bench. <br />Roads <br />Road surfaces, embankments, and road ditches and culverts were in good repair in the main surface <br />facilities area, in Box Canyon, and the West Flatiron area. Straw bales for sediment control have <br />recently been staked in place in downdrains next to the West Flatiron Road. <br />Hydroloeic Balance <br />Ponds MB-2R, MB-3, MB-4, and the RPE ponds appeared to have adequate sediment storage capacity. <br />Ins[opes and embankments were in good repair. <br />The clean water diversion ditches uphill from the materials storage bench were in good repair and were <br />protected by good vegetative cover. They were clear of sediment. <br />Processine Waste <br />The faces of the Refuse Pile Expansion pile and the Lower Refuse Pile showed no evidence of <br />structural instability. Survey mazkers were in place on the faces of both piles. The top of the Lower <br />Pile is being used for equipment storage, as approved. <br />Support Facilities <br />No problems were found on the Materials Storage Bench, the trash compactor area, or the explosives <br />magazine. <br />
