<br />-2- <br />NOTICE OF VIOLATION <br /> <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />Sanborn Sand and Gravel, Inc. to be in violation of Permit M-84-094, <br />specifically C.R.S. 34-32-116(7)(h). <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Sanborn Sand and Gravel, Inc. to: <br />1. Cease and desist from conducting the following mining operations at the <br />Gloria Z Mine - Permit M-84-094: Cease and desist from any stripping or <br />extraction - mining activity outside the current permit boundary. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Submit a complete amendment or conversion application to the Division <br />which covers the affected area outside the permit boundary by 7/23/93. <br />b. Obtain an approved amendment by B/22/93 or an approved conversion by <br />10/22/93 from the Division. <br />c. Submit to the Division an adequate interim bond by the July 21, 1993 <br />Board Meeting. <br />4. The Colorado Mined Land Reclamation Board held the issue of a civil <br />penalty in abeyance until after all corrective actions are completed. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
