III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. The weather was cool but clear. There was some snow on site. <br />Facilities <br />There was only a small to moderate amount of coal being stockpiled on site. During the inspection, no coal haul <br />trucks were unloading into the grizzly. However, rail cars were being loaded and loaded rail cars were on site. <br />There were no problems with fugitive dust offsite. No coal was being tracked onto the main highway by the coal <br />haul trucks. <br />The operator is replacing the old truck weigh station with a new one. In the meantime, the coal haul trucks are <br />being weighed at the Bowie No. I unit train loadout. There were no problems with the mine office and shop <br />area, substation, material storage area and loading facilities. There were no leaks at the fuel facility. The <br />containment berm at the fuel facility was up. <br />Signs and Markers <br />The mine ID signs were up at the main entrance, east gate and along the east road near the railroad tracks. <br />Perimeter markers were up around the site. <br />Roads <br />The main paved haul road was in good condition. The guard rail was in place. The graveled east side entrance <br />road was also in good condition. The light use road along the tracks was muddy but passable. <br />Topsoil Stock~es <br />The vegetative cover on the east topsoil stockpile ranged from poor in spots to good in general. The collection <br />and diversion ditches were well grassed. The topsoil stockpile sign was up. The cover on the west stockpile was <br />good. The collection ditch was well grassed and the topsoil sign was up. <br />Hvdroloav <br />There was only a little ice-covered water in the east sediment pond. The west dugout pond was dry. Pond <br />spillways were operational. The east pond embankment was well vegetated and appeared to be stable. East pond <br />inslopes were also well vegetated. The outslope of the dugout pond was reseeded and mulched just a few <br />months ago. <br />Culverts and ditches were functional. The silt fence and straw bales along the tracks were in place. <br />Records <br />The mine records were in compliance, as documented in the attached records checklist <br />c:/word/terror/i nsp0206 <br />
