(Page 21 <br />MINE ZD # OR PROSPECTING ID # M-2005-066 <br />INSPECTION DATE 12/20/05 <br />INSPECTOR'S INITIALS ESC <br />This was a pre-operation inspection of the Wattenberg Weat Sand and Gravel Site, File No. M- <br />2005-066, conducted by Erica Crosby of the Colorado Division of Minerals & Geology. Maureen <br />Jacoby of Banks and Gesso was present during the inspection. <br />Asphalt Paving Company filed a new 112 Construction Materials Application with the Division <br />on November 3, 2005. The Division's recommendation due date is set for February 1, 2006. <br />Kerr Mc-Gee and Alfredo Ramirez have filed written objections. However, the Kerr Mc-Gee may <br />be have sent in error, due to an a structure agreement that has been signed by both parties. <br />The Alfredo Ramirez letter was sent to the Department of Planning Services in weld County, <br />and is unclear if this letter is intended to object the permit under the DMG's 112-review <br />process. The intent of this letter will need to be clarified by Alfredo Ramirez, and will be <br />handled under separate cover. <br />The mine site is located west of and adjacent to unincorporated town of Wattenberg, <br />approximately 1.5 miles northwest of Brighton in weld County, Colorado. The applicant <br />proposes a 135-acre permit area on property owned by Asphalt Paving Company. Most of the <br />property is currently under agricultural production. The proposed postmining land use is a <br />developed water resources. <br />Mining will be conducted on two parcels of property. The site will be dewatered and dry <br />mined and reclaimed to two interconnected lined water storage reservoirs. Mining will take <br />place in three phases over a 95-acre area. Prior to mining phase 2 and 3, a slurry wall will <br />be constructed before mining below the water table. Phase I will not be enclosed by a slurry <br />wall. It will be dewatered, dry-mined and then backfilled and reclaimed to the original <br />grade. A settling pond located in the processing area will be used to wash the aggregate. <br />Topsoil will be salvaged and segregated from other soil and be placed Co a depth of 12 inches <br />on the finished grade and revegetated. <br />A number of permanent man made structures surround the property including buildings, utility <br />lines, gas wells, gas lines, wells, ditches and roads. The applicant has obtained a number <br />of agreements to mine closer than 200 feet to various structures. If agreements cannot be <br />reached for the other structures, a 200-foot setback will be maintained. <br />The following items were noted during the inspection that will need to be addressed; <br />o Describe the new road that will be built to MEIII. If an existing easement is to be <br />mined through, a notarized agreement must be submitted. <br />o All wells must be located on the map, even the ones that are not registered with the <br />State. <br />o Describe the drainage structures located in the SE corner of the site. <br />o Describe the ditch and well that crosses the mining property leading to the Potato <br />Farm. <br />o Additional hydrology issues not noted in the Division's adequacy letter of December 13, <br />2005. <br />All other adequacy issues have been noted in the Division's adequacy letter of December 13, <br />2005. <br />
