<br />(Page 21 <br /> <br />MINE ID # OR PROSPECTING 10 # N1084-007 <br />INSPECTION DATE 9/18/96 INS ECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This complete inspection was conducted by Wally Erickson, from the DMG field o fice in Durango, 484 <br />Turner Drive, Building F, Suite 101, Durangc, CO 81301, phone (970) 247-5193, in response to operator <br />request. The operator, John Schmahl, requested that DMG review the amount of finan ial warranty required <br />for the Surface Rock Pit. DMG conducted the inspection on 9/18/96, as part of the eview process of the <br />reclamation cost. On 10/11/96, DMG completed its preliminary review, recta ation cost totalled <br />545,820.00. Complete copy of DMG calculations are enclosed with this inspection eport. <br />The Surface Rock Pit is located approximately 22 miles SW of Grand Junction, on Hig way 141, in portions <br />of the SE 1 /4 of Section 9, and portions of the SW 1 /4 of Section 16, both within T14S, R100W, 6th PM, <br />Mesa County. On 5/11 /89, DMG approved AM-02, addressing unresolved mining a d reclamation issues <br />submitted under AM-01, and addressing issues raised by Mesa County Planning De t. Based upon maps <br />approved under AM-02, and maps submitted with subsequent annual reports, the Surf ce Rock Pit operation <br />is approved for the following affected areas: <br />Site A - SE 1 /4 of Section 9 - 18 acres permit area, 9.5 acres affected at any given tf me; and <br />Site B - SW 1 /4 of Section 16 -approximately 10 acres permit area, 4 acres affected at any given time. <br />Total permit area is approximately 28 acres, with 13.5 acres affected at any given ti <br />RECORDS -Confusion exists within the permit records regarding the accurate boundari s of the permit areas. <br />Several series of Mine Plan and Reclamation Plan Maps were submitted under AM-02. nconsistencies exist <br />between map series. Some maps indicate permit area of 90 acres, other map indicate 28 acres. <br />Additionally, annual reports, submitted by the operator for 1 996 and 1995, indicate to al permit areas to be <br />25 acres, and the annual report for 1994 states 26 acres. Please clarify the existing i consistencies within <br />permit records, by submitting an updated Mine Plan and Reclamation Plan Map whi h clearly delineates <br />current permit boundaries and affected areas. <br />FINANCIAL WARRANTY-DMG preliminary recalculation of the reclamation cost totalle 545,820.00. DMG <br />recalculation, dated 10/10/96, was based upon observations made during the 9/18/9 inspection and upon <br />documentation contained within permit records. DMG recalculation assumed current ffected area to total <br />15 acres. Affected acreage was determined as follows: <br />Site A Site B <br />Phase (Area - 5.9 acres Affected area 4 Gres <br />Phase II Area - 3.1 acres <br />Reclaimed Area - 1.0 acres <br />Staging/Crushing Area - 1.0 acres <br />DMG 10/10/96 reclamation cost calculations did not include reclamation of existing st ckpiled material but <br />did calculate reclamation of the area underlying the stockpiled material. Site "reclaimed area", <br />approximately 1 acre area, appeared to be reclaimed; however, DMG 10/10/96 alculation included <br />reclamation cost for this area since DMG has not released liability for the reclaimed a eas at this time. <br />BACKFILL & GRADING - Highwall was visually estimated at 50' tall, benches were eviddnt. Mine Plan states <br />that 10' - 15' wide benches will be maintained at 20' intervals. Although highwall appeared stable, rock fall <br />
