PERSONS INVOLVED (NAMES, ADDRESSES, PHONE NO'S): Formaz and Sons, <br />Inc., P.O. Box 13, Gunnison, Colorado 81230. <br />3. INTENT TO COMPLY/DEGREE OF WILLFULNESS: <br />1. July 7, 1978, first notification to Formaz about unpermitted <br />operation. <br />2. Cease and desist order issued August 24, 1978. <br />3. Application submitted September 25, 1978. <br />4. Incomplete letter sent out October 3, 1978. <br />5. Nemo in 1979, shows that the staff was unable to follow up on <br />this incomplete application <br />6. Memo on November, 1980, states that Formaz never followed up on <br />this and file was dead. <br />7. September 9, 1981, letter to Formaz and Sons, Inc., notified <br />them, that they were still conducting a unpermitted operation and <br />scheduled them beFore the Board on September 23-24, 1981, (yreen <br />receipt). <br />8. New permit application filed after September 9, 1981. Also <br />incomplete. <br />9. September 23-24, 1981, agenda shows that Formaz and Sons was 'to <br />be presented (item No. 15). but notations show it was deleted from <br />that meetiny. (Notations in the file strove that rro legal action was <br />to taken - September 24, 1981). <br />10. On August 17, 1983, Mike Stanton and Rocky Beavers inspected <br />this pit and found Formaz extending their operations and also <br />working out of ttris pit on a state highway pro,)ect. We notified <br />Rick Formaz that they were not permitted and they Insisted that <br />they were, because they had paid the 5125.00 fee. <br />4.
