III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator <br />during the field inspection. <br />Facilities <br />There was very little stockpiled coal on the facilities bench. Most of the coal was being stockpiled in the middle <br />of the facilities area, just to the east of the coal haul truck grizzly. A front end loader was consolidating the coal <br />stockpile. There did not appear to be any coal dust from the coal haul truck unloading operations. There was a <br />little coal dust during the front end loader operations but the dust was only in the immediate area. No rail cars <br />were being loaded during the inspection, although loaded coal rail cars were on site. There were no signs of coal <br />dust being [racked onto the haul road or highway, nor were there signs of coal dust going offsite. <br />There were no problems at the office and shop area, the material storage area, the fuel facility, the substation and <br />the coal unloading and loading structures. <br />Hvdrolo¢v <br />Both the east side pond and the west side pond were dry. Spillways were functional at both ponds. The inslopes <br />of the ponds were stable. The east pond embankment was well vegetated and stable. The gated primary valve <br />was closed. The spillway and riprap were in place at the west pond. <br />The straw bales and silt fence were in place along the railroad track small area exemption and were functional. <br />The operator is planning on replacing the bales and silt fence in a couple of weeks. <br />Topsoil Stockpiles <br />The was a moderate to good vegetative cover on the east topsoil stockpile while the cover on the west topsoil <br />stockpile was good. The vegetation is starting to turn brown from the hot and dry conditions. The collection and <br />diversion ditches on the east stockpile were well vegetated and had sufficient capacity. The collection/diversion <br />berm around the west topsoil stockpile was in place. Topsoi! stockpile signs were up. <br />Roads <br />The paved main haul road was in good condition. The guard rail was in place and there were no signs of coal <br />dust on the road. The light use road along the tracks was in good condition and had been recently repaired. <br />Sins and Markers <br />The mine ID signs were up at the main entrance, the east entrance and along the road near the railroad tracks. <br />The required information was on the signs. <br />c: /word/terror/i nsp0607 <br />
