III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Kathy Welt represented the operator. <br />Facilities <br />There was a truck unloading coal and a rail caz was being loaded during the inspection. There <br />were no signs of fugitive dust problems observed. <br />Coal was stockpiled on the facilities bench.:The facilities bench betm was intact and was <br />functional. The berm azound the fuel facility was also intact. There were no fuel leaks. <br />No problems were observed at the material storage area. <br />Hvdroloev <br />There was no water in pond 1. The gated valve was closed. The pond embankment appeazed to <br />be stable, as were the pond inslopes. <br />The straw bales and silt fence along the railroad SAE were in place and were functional. <br />Roads <br />The paved haul road was in good shape. The east access road was passable. The gate was locked. <br />Tonsoil Stockpiles <br />There were no erosional gullys at the east topsoil stockpile. Topsoil stockpile signs were present. <br />Sims and Mazkers <br />Mine ID signs were up at the main entrance, [he east entrance and where the railroad tracks cross <br />the permit boundary. <br />c: ~ms9Ttetror~ n sp0900 <br />
