III. COMMENTS ~ COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a bond release inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (Division). Basin Resources. Inc., the operator and permittee, filed a <br />request for an industrial land use bond release for two ventilation shaft areas in Apache <br />Canyon on unplatted portions of the Maxwell Land Grant Both shafts occupy an area <br />totaling 1.15 acres. The land is owned by the State of Colorado as part of the Bosque del <br />Oso State Wildlife Area. The Division of Wildlife (DOW) manages the land. Due to other <br />commitments, the DOW and the operator could not attend the inspection. The Office of <br />Surface Mining (OSM) was also invited but could not attend. I was unaccompanied on this <br />inspection. Ground conditions on this day were dry and the weather was unseasonably <br />warm, <br />Backtilling and Grading <br />c. r,;: .~ <br />.:d k.`!_ <br />[~:.-• •. <br />The lower vent site is located on a nearly flat area adjacent to a recently improved road <br />constructed for coal bed methane development on the property. Road building activities <br />encroached on a small portion of the reclaimed area around the capped ventilation shaft. It <br />3 <br />
