<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This complete inspection of the Carbon Junction Coal Mine was conducted by DMG staff from <br />the DMG Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) <br />247-5469. Sandra Pautsky and Shawn Price were located at the mine office and assisted the <br />DMG inspector in a review of the files at the mine office. Soil conditions were wet due to recent <br />precipitation. <br />Records at the mine office were well organized and complete. Details of the records check are <br />recorded on the attached form, DMG AVAILABILITY OF RECORDS. <br />Topsoil Stockpile #2, located adjacent to and west of the rock fill area, had been graded to <br />stable slopes and seeded and mulched. Other topsoil stockpiles exhibited an established <br />vegetative cover and were appropriately signed. <br />Sediment Pond 1, located at the far south end of the permit area, was holding water in isolated <br />puddles. Water depth was visually estimated at 0.5'. No discharge noted. Pond embankment, <br />inslopes and bottom were well vegetated and appeared stable. <br />Sediment Pond 2, located along the west side of the permit area, was holding water. Water <br />depth was visually estimated at 1'. No discharge noted. Pond embankment, inslopes and <br />bottom were well vegetated and appeared stable. Rock check damns, construction within the <br />sediment containment ditch which directs affected area drainage to Pond 2, were intact and <br />functioning as designed. <br />Road side drainage ditches, culverts and sediment containment ditches were intact and clear. <br />Site appeared stable. Equipment, previously parked near the mine entrance, had been <br />relocated to the equipment storage area located on the south end of the MUA. <br />
