NOTICE OF PROPOSED DECISION <br />In accordance with Rule 5.02.2(8) of the Regulations of the Colorado Mined Land <br />Reclamation Boazd for Coal Mining, the Colorado Division of Minerals and Geology <br />proposes to approve a Reduction in Inspection Frequency (RIF) for the Ohio Creek No. 2 <br />Mine (Pernut Number C-80-002). The Division is proposing to reduce the inspection <br />frequency to two complete inspections per yeaz, once in the spring and once in the fall. <br />This RIF is based on a complete inspection of the site performed on 4 May 2004 and <br />findings that the mine site has been stabilized and reclaimed and at this time threat to the <br />public or the environment has been minimized to the extent possible. <br />The Ohio Creek No. 2 Mine is an underground coal mine located in Gunnison County <br />approximately 16 miles North of Gunnison, Colorado. The mine was operated by Robert <br />Weaver. The permit and reclamation bond for the Ohio Creek No. 2 Mine were revoked <br />and forfeited, respectively, by the Mined Land Reclamation Board on 21 February 1996. <br />The exact legal description of the mine is Sl/2 of lots 1 and 2, which said lots aze co- <br />extensive with the SE 1/4 of the NEl/4 and the SWl/4 of the NE 1/4 of Section 16, <br />Township 15 South, Range 86 West, 6th P.M. This azea is 80 acres in size. The permit area <br />can be found on the USGS Mount P,xte117.5 minute Quadrangle. <br />Copies of the proposed decision aze on file for public inspection at the Colorado Division of <br />Mineral and Geology, Centennial Building, 1313 Sherman, Room 215, Denver, Colorado, <br />80203, (303) 866-3567. Persons with an interest who maybe adversely affected by the <br />proposed decision may provide written comments on the proposed decision. Such requests <br />must be submitted to the Division, to the attention of Jim Stazk, within 30 days of the initial <br />publication of this notice, must be in writing and must state with reasonable specificity the <br />reason(s) for the request and the objections} to the proposed decision. <br />
