III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the King Coal Mine for the month of September, 1996. <br />HYDRO BALANCE; Both ponds had water in them but were well below the discharge stage. All <br />culverts were inspected and found to be clear and capable of functioning as designed. Ditches <br />were recently (July) reconstructed/cleaned and are as designed. <br />EXCESS SPOILS: The waste pile and the 100 year diversion ditch were inspected and showed <br />no signs of any problems. The mine is generating waste at a faster pace that in the past and <br />the designs of a newly configured waste pile will now be a top priority of the engineer and mine <br />personnel. The pile currently is very stable and water does not pond on the pile. Currently the <br />mine is waiting for a new topographic map of the minesite to be completed, then a revision to <br />the waste pile will be submitted. <br />
