<br />MINE ID # OR PROSPECTING ID #: M-gg-n8~ <br />INSPECTION DATE: 7/t8/nn <br /> <br />(Page 2) <br />INSPECTOR'S INITIALS: JCS <br />OBSERVATIONS <br />This inspection was conducted in order to check completion of corrective actions required for two <br />compliance problems identified as a result of the Division's inspection of the site on 5/8/00. The pit was <br />inactive at the time of the inspection. The County was represented during the inspection by Nancy <br />Bogenhagen, Cheyenne County Commissioner, and Don Esarey. <br />Although the ID sign posted at the beginning of the inspection was unchanged and, therefore, not <br />acceptable, the County representatives arrived with a new sign that did meet the requirements of Rule <br />3.3.12(1). This sign was being installed at the conclusion of the inspection. The Division considers that <br />Compliance Problem 1, identified during the Division's inspection on 5/8/00, as satisfied. <br />At the pit, the berm required to abate Compliance Problem 2, i.e. separation of the area disturbed by the <br />mining operation from the nearby natural drainage, had been installed, although breached in at least 2 <br />places as a result of runoff from the site due to recent heavy rains. The Division considers that Compliance <br />Problem 2, identified during the Division' inspection on 5/8/00 has been satisfied. <br />Although it is clearly in the County's best interest to restore the integrity of the berm in order to that <br />compliance with C.R.S. 34-32.5-116(4)(h) be maintained, the berm has been breached. This is then a <br />compliance problem that will be included on Pase 3 of this report. It would also be in the County's best <br />interest, when repair of the berm is underway, to extend it farther upgradient along the natural drainage, to <br />provide additional protection against runoff from the disturbed area. It is the Division's understanding, from <br />discussions with the County representatives during the inspection, that the mining and related disturbance <br />will, in the near future, be expanded into the currently undisturbed eastern portion of the permit area. <br />In regard to Compliance Problem 3, identified in the report of the Division's 5/8/00 inspection, the County <br />representatives indicated that the pit had been taken as far northwest as desired and that the current pit <br />might be reclaimed this fall with some of the stockpiled topsoil involved.
