Permit # M-77-526
On behalf of our client Albert Frei and Sons, Inc., I am
responding to your Inspection report. I apologize for taking so
long to get back to you concerning this inspection. The four
observations you made in the inspection report are minor problems
that are easy to correct. i will address each observation in the
order you presented it.
1) The southeast corner of the property is clearly marked with
an 6 foot chain link fence along the east side and running
approximately 800 feet down the south side. I have enclosed
pictures showing the fence as you requested, note the red
marked post is the southeast corner of the site.
2) I have completed the Technical Revision as suggested and
sent it to Mr. Frei for his review and signature. It will
be submitted shortly if it is not already at the Division
offices.
3) Because of the location of the berm the road is the only
access we and our tenants have along the north side of the
lake. To keep the water skiers from entering the active
part of the mine and for safety reasons Albert Frei and Sons
have allowed them to use the road. We are asking for an
extension until September 15, 1996 for additional time to
resolve this issue. By that time we can make arrangements
to change their access. We are looking into a way to create
a road north of the berm for a new access road, but that
will take a couple of months to schedule the equipment
needed for grading. We would like to wait on seeding until
mid October to take advantage of the fall planting season.
We feel this will improve the chances of successfully estab-
lishing vegetation on the berm. We will submit pictures of
