III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of CDMG. This former underground <br />mine is reclaimed. Remaining buildings and structures are approved to remain as permanent <br />structures. Snow covered the north-facing slopes but south-facing areas were free of snow cover. <br />Mr. luppa, the landowner, was contacted but not present during the inspection. George Patterson <br />of Energy Fuels Mining Company was present during the inspection. <br />Hydrologic Balance <br />A contractor hired by EFMC was on-site actively cleaning sediment from the sediment pond. The <br />work began on the morning of this inspection. This material was being removed using an <br />excavator and stacked where it was subsequently loaded into dump trucks. Due to the extended <br />drought, conditions in the pond were good for removing the accumulated sediment. An area of <br />approximately 40 feet by 60 feet had been excavated to a depth of about 5 feet. Mr. Patterson <br />explained that an area of about 60 feet by 90 feet by 6 feet deep would be excavated to complete <br />the project. The material was being hauled and dumped along the refuse slope toe to dry out. It <br />will be re-spread once it dries to a workable condition. <br />Revegetation <br />Cattle were not observed on the site. Although winter conditions prevail regarding vegetation, <br />standing live vegetative cover and litter are sparse. Drought conditions have had a major impact <br />on the site. <br />Overall, the site appeared in fair condition. <br />Page 3 <br />
