Because more permitted area lies on the SW side of the ditch, <br />and the setback from the ditch is for both sides of it, this creates a 400-foot wide strip <br />of unpermitted land. The operator now recognizes that the establishment of the new 112 <br />boundaries with the deep setbacks has made a significant number of acres unavailable for <br />mining. He stated during the inspection he would be interested in exploring the feasibility <br />of a "land exchange". There is a brief list of conditions which must be met or agreed to for <br />this to be an option available to the operator. This list is enclosed for the operator to <br />review. Please contact this inspector to discuss it! <br />There is a bond of $1700 for this operation, which was calculated at the time of permit <br />conversion. The bond is to cover the costs of earthwork grading. Though no problem is noted <br />for the existing steep highwalls or irregular pit floor, the reclamation costs wil be <br />recalculated soon to verify that the State holds enough bond for the present amount of <br />unreclaimed disturbance. The operator may greatly influence the total bond required by <br />performing reclamation in a timely manner, and fully reporting all tasks accomplished. <br />There were no other items noted or discussed during the inspection.
