111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the New Horizon Mine for the month of December, 1998. <br />HYDROLOGIC BALANCE: Mine 2: Pond 7 had water in it but was not discharging. All ditches and <br />culverts were clear and capable of functioning as designed. The site for pond 8 was inspected to <br />determine what measures could be taken to eliminatelresize the pond. It was determined that a <br />diversion ditch could be installed that would eliminate the need for a new pond until after the coal <br />was mined out and the land restored to its AOC configuration. During the construction of the <br />haul road around the SW corner of the property, an impoundment would be necessary to trap and <br />treat a small area where runoff could not be diverted. <br />BACKFILL & GRADING: B & G was in progress as is normal. <br />TOPSOIL: The topsoiling for this year had just been completed and another will commence again <br />sometime in January. <br />RECLAMATION SUCCESS: Vegetation continues to do exceptionally well. The growing season is <br />over and the site shows no signs of any rills or gullies. <br />
