III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspecton. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the field inspection. <br />Roads <br />The paved main haul road was in good condition. The east entrance graveled road was also in good <br />condition. The dirt light use road along the railroad tracks was passable. <br />Facilities <br />During the inspection, a front end loader was dumping coal into the grizzly and rail cars were being <br />loaded. There were no signs of fugitive dust offsite. There were no indications of coal dust on the <br />highway. <br />There were no problems noted at the office, shop, electrical substation, material storage area and the <br />loading facilities. There were no leaks at the fuel facility. <br />The operator has cut down bushes and small trees and cut and mowed the tail grass around the loadout <br />Hydrology <br />The elevation of the standing water in the east pond was about 1 foot below discharge. The primary <br />tube gate valve was closed. The pond inslopes were well vegetated. The pond embankment was also <br />well vegetated and appeazed to be stable. The west pond was dry. The spillway and riprap were in <br />place. The reseeded outslope is starting to come in. <br />The culverts and ditches leading to the east pond were all functional. The straw bales and silt fence at <br />the railroad small area exemption were in place. There was a small flow of water in the private <br />irrigation ditch located on the west side of the property. <br />Topsoil Stockades <br />The east topsoil stockpile had moderate to good vegetative cover. The collection and diversion ditches <br />were in place and had sufficient capacity, The topsoil sign was up. The west topsoil stockpile had a <br />good cover of vegetation.
