<br />(Page 21 <br /> <br />MINE ID # OR PROSPECTING ID # M$6-061 <br />INSPECTION DATE 9120195 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This complete inspection was conducted by Wally Erickson from the DMG field office in Durango. Mr. Don Gosney, Gosney & Sons <br />Construction, accompanied the DMG inspector through out this inspection. On 9120/95, DMG received request for release of <br />performance and financial warranty for 2.6 acres for completion of reclamation conducted in the Phase 1 area. The request for <br />warranty release shall be referenced as SI-01. This inspection is the warranty release inspection required by Rule 4.16.1151. <br />Mine identification sign and affected area perimeter markers were located in accordance with Rule 3.1.12. Affected area perimeter <br />markers are essential to ensure that mining activities remain within approved areas. All activities were within marked boundaries, <br />as approved in the original permit application and Technical Revision - 01 ITR-011. <br />TR-01, submitted 9/14/95, requested change in Post Mining Land Use IPMLUI for 2.6 acres from rangeland to livestock feeding <br />area and also requested revision of the permit boundary. Under TR-01, the permit boundary was modified to include 2.6 acres on <br />the north end of the Phase 1 area. Mr. P.L. Cugnini, landowner/operator had requested that Mr. Gosney continue the operation an <br />additional 2.6 acres beyond the original permit boundary to remove a small "ridge" that would otherwise result from the approved <br />mining and reclamation plans. Mr. Cugnini stated his request in a meeting with Mr. Gosney and DMG inspectors at the DMG office <br />in Durango. Mr. Cugnini stated that removal of the "ridge" would enhance the PMLU by providing additional acreage available for <br />ranching activities. <br />The 2.6 acres requested for warranty release under SI-01 was graded to a level configuration in accordance with the approved <br />reclamation plan. The 2.6 acre area appeared stable, no evidence of erosion was located. Vegetative cover consisted of Yellow <br />sweet clover, Sun flower, Rubber rabbit brush, and various grasses. Successful establishment of vegetative cover is not a condition <br />of SI-01 due to a change in PMLU from rangeland to livestock feeding area ITR-011. Reclamation for the 2.6 acres appeared <br />complete, the 2.6 acres has been reclaimed for beneficial use in accordance with the Rules and Regulations and in accordance with <br />the approved plan, DMG recommends approval of SI-01. <br />Mining activities appear to be near completion for the Phase 1 area. Approximately 200 feet of highwall has been backfilled and <br />graded to 3H:1 V slope. The approved reclamation states that backfilled slopes shall not be steeper than 2H:1 V. Remaining <br />highwalls were approximately 30 feet high and appeared stable. A drainage containment berm, located along the edge of the <br />downhill slope, was still under construction. When completed, the berm will temporarily detain disturbed area drainage, thereby <br />control erosionlsedimentation on site and ensure offsite adverse impact not occur. The outslope of the berm was being regraded <br />to blend with natural undisturbed slopes. The finished portion of the berm was neatly graded and blended with natural slopes, <br />disturbances to vegetation located at the toe of the slope had been minimized. <br />Mr. Gosney's efforts to beckfill highwalls to 3H:1 V rather than the allowed 2H:1 V slope configuration and construction of the <br />extensive containment berm ere evidence of his desire to minimize adverse impacts and return the land to beneficial use.
