• (Page 2) • <br />MINE ID # OR PROSPECTING ID # M-79-070 <br />INSPECTION DATE March 19, 1999 INSPECTOR'S INITIALS TAS <br />OBSERVATIONS <br />1. A site inspection was made of the Rossum Pit as a follow-up to an aerial inspection <br />conducted by the Division on October 7, 1998. <br />2. The status of the Rossum Pit is "awaiting warranty". On August 21, 1979 the Mine Land <br />Reclamation Board approved an application for a Limited Impact 110(2) application for 9.82 <br />acres submitted by E.A. Rossum. The financial warranty set at that time was $2,500. To <br />date, no financial warranty has been submitted. Therefore, a mining and reclamation permit <br />has not been issued to E.A. Rossum. <br />3. On November 18, 1996, the Division of Minerals & Geology approved a 110c mining permit <br />application for 9.3 acres. (The same acreage as listed in the original 1979 Limited Impact <br />110(2) Application). The applicant (permittee) and surface owner was listed as Howard <br />Nicholson. The permitting contact was listed as George Faucher of Loveland Ready Mix. On <br />Sune 13, 1996, the Division received a a corporate surety application for the Rossum Pit <br />Erom Loveland Ready Mix. On July 23, 1996 the corporate surety application was returned to <br />Loveland Ready Mix due to administraCive deficiencies. The amount of financial warranty <br />required by the Division for this operation is $7,100. To date, the deficiencies with the <br />financial warranty have not been corrected and a mining permit has not been issued to Howard <br />Nicholson. <br />4. This inspector confirmed that none of the 9.82 acres have been disturbed by mining. (The <br />original 9.82 acres encompass the 9.3 acres listed in the 1996 application) A minor portion <br />of this area has been converted to residential development and a golf course. The remaining <br />portion of the permit area remains as agricultural land. <br />5. In order for any any mining to take place at this site, a mining and reclamation permit <br />will first need to be issued to either E.A. Rossum or Howard Nicholson. Permit issuance can <br />be achieved by submittal of an adequate financial warranty and approval of the Colorado Mine <br />Land Reclamation Board. Board approval is necessary since more than 12 months have lapsed <br />since Division approval of the 9.82 acre Limited Impact 110(2) application. <br />6. The Division considers the lack of an adequate financial warranty for the approved Limited <br />Impact 110(2) application to be a problem. Rule 4.1(2) requires that no permit may be issued <br />pursuant to the Act until the Board or Office receives and approves the Performance and/or <br />Financial Warranties required herein. If these Warranties are not received within one <br />calendar year of approval of an application for any new permit, amendment, or conversion, the <br />Board shall hold a hearing to reconsider the previous approval. Therefore, the Division <br />requests that Mr. E.A. Rossum complete one the following actions on or before April 23, 1999: <br />A) Submit a written request to withdraw permit application M-79-070. OR <br />B) Complete all public notice and notification requirements as specified in Rule 1.6.2, <br />submit adequate performance and financial warranties, and submit a written request to appear <br />before the Colorado Mine Land Reclamation Board for reconsideration of the previous Division <br />approval. Failure to complete one the above mentioned actions by April 23, 1999 will result <br />in the Division scheduling a hearing before the Board at the May 26-27, 1999 Meeting to <br />
