OBSERVATIONS <br />This was a partial inspection to determine the total acreage included within permit boundary markers recently located by the <br />operator, Mr. Van Ella. Attending the inspection were Carl Mount and H. Bruce Humphries of the Division of Minerals and <br />Geology and James Van Ella and Deanna Van Ella, the operators. <br />The operator has constructed a large garage like building and several small out buildings to act as summer residence and <br />minimal equipment storage for the mining operation which many tourists visit each year. The buildings are not considered part <br />of the mining operation and are not included in the permit area. The operator has submitted a letter dated September 26, 2005 <br />and received at the Division of Minerals and Geology office on September 28, 2005 that states that the building is not <br />considered part of the permit area and is used only minimally for the mining operation. Therefore, the Division will not consider <br />demolition of the building in the reclamation band. This also solves Problem #2 of the September 27, 2004 inspection report. <br />Global Positioning System measurements were taken to determine the acreage marked out by newly placed permit boundary <br />markers. The operator has placed permit boundary markers around all the permit area to inscribe a permit boundary that <br />measured 3.06 acres which is close enough to the 3.0 acres now permitted. This means Problem # 1 of the September 27, <br />2004 inspection report is no longer a problem. <br />The operator has also installed boundary markers for the as yet incomplete amendment. Mr. Mount of the Division measured <br />these areas for the operator with the Division GPS unit. The markers installed indicate an area to the west of the presently <br />marked permit area as containing 1.55 acres. The markers to the north of the present permit area contained 1.43 acres. The <br />markers to the east contained 5.40 acres. Total area inscribed by the present markers for the possible amendment is 11.44 <br />acres. The operator could cut down the amount of acres in any of the areas to the west, north or east to plot out a total <br />acreage of less than 10 acres if the amendment to the permit is wanted (Total acres allowed under a 110 Limited Impact Permit <br />must be less than 10.0 acres). <br />The Division received a Technical Revision from the operator on September 28, 2005 requesting a change in reclamation for <br />the south highwall of the pit area. The Division has reviewed and approved this technical revision and will send an approval <br />letter to the operator at a later date. This solves Problem #3 of the September 27, 2004 inspection report. <br />Problem #4 related to water rights has been referred to the Office of the State Engineer. <br />The possible amendment to the permit was discussed on site. The operator could submit the necessary documents to make <br />the previously submitted incomplete amendment application complete and proceed to approval of that application and get 9.99 <br />acres of permit area to include the 1.3 acres of already disturbed area and any other areas that would have to be disturbed by <br />mining and reclamation activities. Such information to make the amendment complete includes: <br />a. A completed application form, <br />b. Proof of filing with the County Clerk, <br />c. Proof of Mailing Notices of Amendment Application to the County Board of Commissioners and the Board <br />of Supervisors of the local Soil Conservation District, and <br />d. An affidavit of Posting Notice at the mine site. <br />Also discussed was the need to publish notice once in a newspaper of general circulation around the mine site. Enclosed with <br />this report is an example of such a notice. <br />Responses to this inspection report should be directed to Carl B.
