III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II-W Mine conducted on January 28, 2003 by Mike <br />Boulay of the DMG. Lori Smith of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were cloudy and cold. The majority of the site was snow <br />covered. Coal was not being hauled from the mirte at the time of the inspection. Dozers were <br />working to strip topsoil adjacent to Haul Road L in the vicinity of the crop line in the South Area, <br />and the dragline was operating in the South Pit. <br />Roads <br />Road surfaces were very muddy and partially snow covered throughout the site. A grader was <br />working to cleaz mud and snow from Haul Roads A, L, and H at the time of the inspection. <br />The G Road was not accessible due drifted snow. <br />Hydrologic Balance <br />Site Ponds 006 and 016 were the only sedimentation ponds accessible due to snow packed road <br />conditions. Pond 016 was viewed from above on Haul Road J. Both ponds were frozen ahd <br />neither was dischazging. There was flowing water in the ditches along Haul Road A. Road <br />ditches and culverts along Haul Roads L and H were snow packed. <br />General Mine Plan Compliance <br />A dozer was working in the B Pit removing overburden in prepazation for coal removal. The <br />current operations plan indicates that coal removal was scheduled for 2001 in the B Pit. SCC has <br />indicated that the operations plan will be updated to include coal removal at the B Pit in 2003. <br />This will be accomplished via Technical Revision No. 42 or Permit Revision No. 3. TR-42 was <br />received by the Division on February 3, 2003 and has not been deemed complete. PR-03 is <br />pending approval. To ensure compliance, coal removal in the B Pit shall not proceed until the <br />operations plan has been updated and approved. <br />Slides and Damaee <br />A spoil slide occurred in the South Area Pit some time prior to this inspection. The spoil <br />material slid back into the active pit area. Based on this inspection, the slide does not appeaz to <br />have caused any damage to topsoil or other resources. <br />
