C~
April 1, 1991
III IIIIIIIIIIIIIIII
a~
RECEIVED
APR 0 4 1991
Mined Land
Reclamation Division
Mined Land Reclamation Division
1313 Sherman St. Rm. 215
Denver, CO. 80203
Attn: Mr. Bruce Humphries
Dear Mr. Humphries,
It has come to my attention that your department has a
gravel pit operating illegally in Moffat County. You have
this in your files as the "Ross Pit".
I observed gravel being hauled out of this pit yesterday
and know gravel has been removed from the pit for the last
30 days. It's being hauled by persons known locally as
"The Bower Bros." and Wes Hertzog.
I don't have a legal description but it is 9 miles east of
the junction of Co. 399 and Moffat County Road 107 on Co.
399.
I understand that Jim Ross was issued a permit sometime in
December but that he failed to submit a reclamation bond to
your department. It is obvious that until the reclamation
bond is on file in your department it is illegal to remove
gravel from said pit. Jim Ross having applied for a permit
with your department has knowledge that no reclamation bond
was submitted and therefore is knowingly breaking the law.
He is not complying with the laws of the State of Colorado.
Your prompt attention to this illegal matter will be
greatly appreciated. I will keep in touch to determine the
progress being made.
Sincerely,
Anonymous
cc: Rep. Dan Williams
