III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Matr Strip Mine conducted on October 20, 2004 by Mike <br />Boulay of the DMG. Weather conditions were cloudy and windy. Ground conditions were damp <br />and muddy. There were no representatives from Kerr Coal Company present during the <br />inspection and there was no activity at the mine site. <br />Roads <br />The permanent light use road was rutted from recent traffic during wet conditions. The road was <br />damp but passable at the time of the inspection. Road ditches were stable and in good condition. <br />As noted below, some minor rills have formed above the road ditch on the west side of the light <br />use road. <br />Hvdroloeic Balance <br />Sedimentation Ponds C, D, E, F, and G were viewed. None of the ponds were dischazging but all <br />were retaining significantly more water than at the time of the last inspection. Pond G was only <br />holding a few inches of water. Pond embankments, inlets and dischazge structures were stable <br />and no problems were noted at any of these sediment pond locations. Ponds A and B were not <br />inspected. <br />There appears to be more available moisture at the site as compazed to this time last yeaz. There <br />also appears to have been significant recent runoff at the site. This was evident by the minor rills <br />that have formed in some locations along the west side of the permanent light use road above the <br />road ditch directly across from the surface facilities azea and in isolated locations fiuther to the <br />north along the road. The rills aze not prohibiting successful revegetation and do not appeaz to be <br />disrupting the approved postmining land use at this time. If the rills deepen and become <br />problematic, then these azeas will need to be regraded or otherwise stabilized. Small amounts of <br />dried grass and sediment were deposited in the Pond D inlet indicative of recent rainfall and <br />runoff into the pond. <br />
