III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Pond B dischazge flow paths aze perpendiculaz to the length of the Deer Trail Ditch. According to Fire <br />Mountain and Bowie Resources personnel, a dischazge from the Pond B primary discharge tube went <br />through a hole in the side of the Deer Trail Ditch and into the Fire Mountain Canal. Fire Mountain <br />Canal personnel saw the pond dischazge water flowing down the Fire Mountain Canal arid requested <br />Bowie Resources personnei to repair the hole in the Deer Trail Ditch. That repair work was, then, <br />done. In this azea of the Deer Trail Ditch, the vegetation was also thick with weeds and small trees. <br />The inspection finished at the westernmost end of the Deer Trail Ditch. There was no water in the Deer <br />Trail Ditch at this location. The water that would flow to the west end of the Deer Trail Ditch passes <br />through an 18 inch diameter culvert over the Fire Mountain Canal. The water then flows in a ditch on <br />the west side of the Tenor Creek Loadout, under the railroad tracks, and into a field. <br />At the closeout to this field inspection, the DMG requested that representatives of the Fire Mountain <br />Canal submit a letter that details exactly what issues that organization has with the Bowie No. 2 Mine <br />and the Fire Mountain Canal and what solutions they believe are needed. The Fire Mountain Canal <br />representatives agreed to write this letter. This letter will be sent to Bob Major, who said that he will <br />write his own letter to the DMG regazding the concerns of the USBR. Either the information contained <br />in the Fire Mountain Canal letter will be incorporated into the letter from the USBR to the DMG or it <br />will be included as an attachment to the USBR letter to the DMG. <br />c: /word/bowie2 /insp 1004 <br />4 <br />
