III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This partial inspection of the Coal Gulch Mine was conducted by DRMS staff from the Durango Office, <br />701 Camino del Rio, Room 125, Durango, CO 81301, (970) 247-5469. The permit was revoked in a <br />previous decade, financial warranty was forfeited and utilized for final reclamation. One photo <br />accompanies this report. <br />No activities were observed; no individuals were contacted during the inspection. Cable gate was <br />locked at the mine entrance. <br />Sediment pond was holding water. Water level was visually estimated at 4 feet below the inlet for the <br />primary spillway. Inlet for the primary spillway appeared to be a metal pipe, however, no outlet for the <br />primary spillway pipe was found. Primary and secondary spillways for the pond had previously been <br />removed by landowner activities. Minor water, approximately 8-inch depth, was impounded in a low- <br />lying area at the north end of the permit area. <br />Water was not flowing in the Coal Gulch stream channel. The landowner has reconfigured the <br />alignment of the channel to report directly to a large, approximate 48"diameter, concrete culvert for <br />Hwy 160. The result of the realignment of the channel has resulted in sediment being delivered to the <br />inlet of the culvert. Sediment deposition at the culvert inlet appeared to have obstructed approximately <br />40% of the culvert's capacity. <br />Industrial debris, imported by the landowner, has been stockpiled on site. <br />
