III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on January 24, 2006 by Mike Boulay <br />of the DMG. Roy Kazo of Seneca Coal Company was present during the entire inspection. <br />Weather conditions were sunny and cold. The mine site was entirely snow covered. Coal was <br />being hauled from the Wolf Creek pit in the Yoast South Area. A scraper was needed to push the <br />haul trucks up and out of the pit azea. The dragline was located in. the Yoast South Area but was <br />not operating at the time of the inspection. <br />Roads <br />Haul Roads A and B and the road into the active pit azea were bladed and well maintained. <br />Ditches and all culvert inlets and outlets along Haul Roads A and B were covered in several feet <br />of snow. The active Wolf Creek pit in the Yoast South Area was accessible and was inspected. <br />The exposed Wolf Creek coal seam in the final pit is approximately 20 feet thick. Former Haul <br />Road D and the North Pit azea were not accessible due to dried snow and ice. The road into <br />Pond 011 had been plowed and was accessible. <br />Hydrologic Balance <br />Sedimentation Ponds 010, 011, and 012 were viewed from the accessible roadway. The surfaces <br />of all ponds were frozen and snow covered. Pond inlets and embankments at all sediment ponds <br />were snow covered. The water leve] in all of these ponds was below the level of the principal <br />spillway. No problems were noted at any of the sediment pond locations. <br />Slides and Damage <br />The location of the slide that occurred above Pond 012 was inspected from the haul road. It <br />appears that the site of the slide is remaining stable and no additional cracking or slumping has <br />occurred. <br />
