Pa e 2 <br />MINE ID A OR M-198&102 INSPECTION DATE: 11/092008 INSPECTOR'S RMW <br />PROSPECTING ID #: INITIALS: <br />OBSERVATIONS <br />This inspection was conducted in response to an amendment application submitted to the Division of Reclamation, <br />Mining and Safety (Division) on September 15, 2006 for the purpose of increasing the affected area and changing <br />the post-mining land use and slope configuration. Present at the inspection were Richard Wenzel representing the <br />Division and Laity Thompson and Ted Pratt representing the operator. <br />The amendment application proposes to add approximately 19.12 acres to the existing permit, which currently <br />includes 50.52 acres, for a total acreage of 69.62 acres. Of the 19.12 acres, approximately 3.2 acres will be added <br />to the southwest comer of the current permitted area while approximately 16.42 acres will be added to the east of <br />the existing permitted area. The acreage being added to the southwest comer is being added in order to include <br />approximately 6,000 cubic yams of topsoil within the affected area in order to make it available for reclamation. No <br />mining is anticipated to take place in this area. The boundaries of the additional acreage to be added to the existing <br />permit were properly marked with wooden survey stakes and flagging. Photographic documentation of this is <br />presented on page four of this report. <br />The acreage being added to the east of the existing permit area is being added for the purpose of mining. The <br />northeast and southeast comers of the expanded permit area were marked with metal stakes and flagging. The <br />distance between the east permit boundary and the west property line of the adjacent landowner, the Spurlin's, was <br />measured and confirmed to be 210 feet. An existing residence, garage, and water well were observed within the <br />permit boundaries for the proposed expansion. These structures are owned by the Thompson's. According to <br />Larry Thompson and Ted Pratt, the residence will be moved off site but the garage will remain. A five strand barbed <br />wire fence and several power poles were located along the north property line. The fence was depicted on the Pre- <br />Mining Map however, the power poles were not. Outside of the permit boundaries but within 200 feet of the <br />affected land were several structures owned by the Mirabito's. These structures include one house; two sheds; one <br />bam; and one waterwell. Several of these structures were not identified on the Pre-Mining Map. They include the <br />shed west of the main residence; the water well; and the bam. <br />The amendment application for the proposed expansion of the existing operation is currently being reviewed by the <br />Division and the information obtained from this inspection will be considered in the review. Following completion of <br />the review, the Division will inform the operator of any deficiencies in the application in the form of an Adequacy <br />Review letter, to which the operator will be provided an opportunity to address the deficiencies. Because the <br />amendment application has received objections from adjacent landowners, the amendment application has been <br />scheduled to be heard before the February 14-15, 2007 meeting of the Mined Land Reclamation Board for approval <br />or denial. However, prior to the Board hearing, apre-hearing conference involving all involved parties has been <br />scheduled for 11:00 a.m. on Wednesday, January 24, 2007 in Granby, Colorado.
