III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Gillis of the Colorado Division ofMinerals and Geology. <br />With the operator's consent, this report was issued from the Durango office. Skies were partlycloudy and <br />the site was fairly wet as a result of moderate rainfall the previous evening. <br />Hydrologic Balance <br />Both sediment ponds were inspected and found to be functioning properly. Collection ditches were clear, <br />culvert inletloutlets were open, and berms were in place where needed. The diversion ditch system was <br />also inspected and found to be free of obstructions. No signs of recent sloughing were observed along the <br />base of the cut slope situated adjacent to the North side of the refuse pile. <br />Processing Waste <br />Placement of waste material in the refuse pile appears to be in compliance with the approved design <br />parameter for maintaining positive drainage off the top of the pile. <br />Support Facilites <br />The operator is in the process of refurbishing the leach field situated adjacent to the bathhouse. The <br />portion of the drainage ditch which skirts the edge of the excavation should be temporarily reinforced to <br />ensure that any significant surface flows will not flood the excavation. <br />
