ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ti+-~nna_ma <br />INSPECTION DATE: 6!.?~/04 INSPECTOROS INITIALS: ~- <br />OBSERVATIONS <br />The Division conducted a pre-operational inspection of the site on 6/22/04. <br />The site is being proposed for a 110 sand and gravel operation. Present <br />during the inspection were, Mr. Joseph Febbraro the operator and Mr. Don <br />Fodor, the consultant. The site is located approximately 15 miles North <br />East of Trinidad, Colorado. <br />Permit application site was properly posted at the entrance gate. The <br />entire permit area is fenced and the operator's consultant pointed out the <br />corner posts. The proposed permit area consists of two parcels connected by <br />a road totaling 9.96 acres. There is a small pre-law disturbance with what <br />appeared to be an overburden stockpile, that is now included in the permit <br />area. The operator asked why he was required to get an agreement with <br />himself to mine the area, when he owns both the surface and mineral rights. <br />He was informed that it must have been a misunderstanding. If the landowner <br />is also the operator and mineral rights owner, all the Division requires is <br />a DEED showing that to be the case, to satisfy RULE 6.4.15. The site was as <br />described in the reclamation permit application. The only man made <br />structure that was not mentioned in the application is an old irrigation <br />ditch south of the permit boundary, which is owned by the operator <br />according to Mr. Febbraro. Prior to the end of the inspection, both the <br />operator and the consultant were notified that the warranty submitted was a <br />bit low and that it will be addressed during the adequacy comment. <br />I & E Contact Address <br />NAME: MR.
