III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations
made during the inspection. Comments also describe any enforcement actions taken during
the inspection and the facts or evidence supporting the enforcement action.
December 21, 1994, a complete inspection was conducted at the O.C. No. 2 Mine.
Conditions at the mine were clear and cold. Winter snowcover of 1 foot or more made
accessibility limited to foot travel. The 1/2 mile road west of Mildrid Staples house
was not plowed. The last 1/4 mile to the mine and the snowcover at the mine was
untracked.
The O.C. Mine is in permanent closure and the mine will be completely reclaimed next
summer.
The mine site was posted at the entry with the information required in Rule 4.02.2.
However, this slan must be updated by January 15, 1995, to reflect recent
changes as a result of the mine closure. The contact address and telephone number
on the sign should be changed to the residence of the mine operator, Mr. Weaver, if
mail is no longer received at the mine and telephone service has been cut.
The operator, Mr. Weaver, was contacted at 7:30 am the morning of the inspection but
was unable to meet with the inspector because he was just getting ready to leave
town. The following records are kept by the operator for the purpose of public
availability. However, recent changes in the Division's policy will require the records
to be kept at the county courthouse.
Availability of Records- The following records are required to be kept on file at the
Gunnison county courthouse as of January 15, 1995.
Item
Comments
DMG Permit Issued May 15, 1992
Permit Application w/ Revisions Single 3-ring binder
Findings Document Dated May 15, 1992
Insurance Certificate Titled "common policy declarations" coverage from 4/28/94 to 4/28/95
Bond Document NlA, in Dec. 1992 the Division cashed irrevocable letter of credit.
