III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion o} observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. Kathy Welt <br />represented the operator. <br />Facilities <br />Coal railcars were being loading during the inspection. Coal haul trucks and a front end loader <br />were dropping coal into the grizzly. There were no offsite problems with fugitive dust. <br />There were no leaks at the fuel facility. The containment berm was functional. The berm at the <br />outer edge of the facilities bench was also functional. The coal stockpile was away from the <br />facilities bench edge. <br />Roads <br />The paved haul road was in excellent condition. The guard rail was in place. The east side access <br />road was also in good condition. <br />Suns and Markers <br />The mine ID sign was up at the entrance to the site. Topsoil signs were in place. <br />Hydrolo~ <br />Both sediment ponds were dry. Spillways were functional. Pond embankments were stable. The <br />vegetation on the pond embankments was very dry. <br />Straw bales and silt fence were up along the railroad track SAE. <br />Topsoil <br />There were no problems with erosion on the east and west topsoil stockpiles.
