~ ~ M <br />This was a normal monitoring inspection conducted by Tony Waldron of DMG along with Mike <br />Elder of Robinson Brick Company. The site is located approximately 7.5 miles northeast of <br />Kiowa, Colorado. The mining area consists of five phases located in three different <br />locations. Phases I', II and V are located on and around an orphan knoll that has been mined <br />For gravel as well as clay. Phases III and IV are located in relatively level areas on the <br />eastern side of a prominent ridge in the area. The only active mining is currently occurring <br />in phase III, although no mining was taking place during this inspection. Phase IV has not <br />been disturbed and phases I, II and V have been mined out and reclaimed. <br />There were proper identification signs and boundary markers at all of the sites. There is <br />a sizeable stockpile of clay located on the northwest side of phase III. Mining is occurring <br />just to the south of this stockpile and is nearly complete at this time. The eastern side of <br />the pit has been mined out and topsoil had been replaced over the regraded area. There is <br />a berm of topsoil/overburden along the southern end of the permit area, which is currently <br />serving as a water retention berm that, will be used to reclaim the final pit area. It did <br />not appear that the top soiled area had been seeded and was mostly vegetated with Russian <br />thistle and kochia weed. <br />As mentioned, phases I, II and V have been mined out and reclaimed. The area had been seeded <br />and the grass establishment was very good in some places and sporadic in others. This is <br />probably to be expected since the pre-existing vegetative cover was probably very spotty and <br />it does not appear that there was an abundance of topsoil available for reclamation. Another <br />interesting development on these phases is that a domestic dwelling has been constructed <br />right on top of the knoll. It is not clear exactly what the relationship is between the <br />owners of the dwelling and Robinson Brick, however, the occupants have affected portions of <br />the reclaimed area with their activities. Since the area appears to be adequately reclaimed, <br />the operator may want to pursue a partial financial warranty release for those areas that <br />have been reclaimed in phases I, II and V to avoid a potential conflict of interest with <br />respect to land use of the reclaimed areas. <br />The current financial warranty is $30,900.00 which is adequate to reclaim the current <br />disturbance in phase IV and conduct any reseeding or maintenance activities associated with <br />phases I, II and V. As long as the disturbance does not exceed the current level, this <br />amount of financial warranty will be adequate. If additional acreage is opened up in phase <br />III along with the present disturbance in phase IV, the reclamation liability would need to <br />be re-evaluated at that time. <br />No problems were noted and this concluded the inspection. <br />I & E Contact Addres <br />NAME Mark S.
