III. COMMENTS - COMPLLANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator <br />during the field inspection. <br />Well Field <br />The access road leading to this site was in good condition. The mine [D sign was up at the entrance and surface <br />disturbance markers defined the disturbed area boundary. The topsoil stockpile was well vegetated and the <br />topsoil sign was on the stockpile. There were no problems with the well pump house. <br />Run-of--Mine (ROMl Stockpile <br />Most of the ROM material was shipped out previously. Underneath is soil material for backfilling the East Mine <br />cut slopes. The haul road was in good condition with the mine [D sign up at the entrance. Surface disturbance <br />markers were up as well. There was a little water in the sediment pond. The gated primary discharge tube valve <br />was in the closed position. The riprap in the emergency spillway was intact. The collection ditch leading to the <br />sediment pond had sufficient capacity. There were only a couple of small pools of standing water on top of the <br />stockpile. The sideslopes of the stockpile were well vegetated. <br />Unit Train Loadout <br />Earlier in the day, the Loadout spur track was being used by Union Pacific work crews for track maintenance <br />further up the valley. During the inspection, the only activity was a lone dump truck taking the demolished silo <br />concrete that had been crushed to gavel size to the Bowie No. 2 Mine. All three entrances were open and a <br />mine ID sign was up on each gate. <br />The sediment control system was working properly at the Loadout. The west side collection ditch was well <br />vegetated and had sufficient capacity. The central clean water diversion ditches and culverts were transporting <br />irrigation water through the site without a problem. The clean water side ditch that leads from the eastern most <br />entrance gate to the central clean water diversion ditch will need a little maintenance soon. <br />The sediment pond was dry. The gated primary discharge tube was closed. The bin wall embankment was <br />stable. The upland diversion ditches and culverts were functional. <br />The reclaimed west end of the spur track is holding up nicely, although some more silt fence is needed. <br />West Mine <br />The backfilled west mine was stable. The vegetative cover was moderate. There was a little water in the lower <br />sediment pond while the upper pond was dry. Mine ID signs were up.
